Complex Litigation
A case is designated as complex litigation by court order for (a) a large number of parties, (b) complex issues and relationships, (c) difficult legal questions and/or (d) complicated facts or unusual problems of proof.
The court assigns a special master to oversee the case, issuing case management orders relating to timelines, discovery and depositions. Your attorney must be able to stay on top of — or ahead of — the issues and deadlines. If the case proceeds to trial, as it often does to sort out the entanglements, trials can last as long as six months. Is your legal counsel prepared to stick with it?
Luke Ciciliano settled a case in May 2007 involving 20 plaintiffs and multiple defendants. The case centered on real estate investment loans and involved multiple transactions over several years.
