Don't Count On the Victim Dropping the Charges — The Prosecutor Decides

Do not make the mistake of treating a domestic violence charge lightly because you think the other person will change his or her mind.

It's common in domestic violence cases for a spouse or romantic partner to call the police during an altercation because they want the heated argument to stop. Once the police arrive and the situation is under control, the "victim" often does not want their spouse or partner to be charged with a crime.

Unfortunately, it's no longer their choice. In Nevada, when police respond to a domestic violence call, they almost always arrest someone. Once an arrest is made and someone is charged with domestic violence, it is the prosecutor and the State that is pursuing the charge, not the "victim." The prosecutor will bring a spousal abuse case even if the victim is unwilling to cooperate.
