Felony DUI (Third Offense)

Three offenses within 7 years of driving under the influence of alcohol (or drugs) constitutes a Class B felony under Nevada law. The minimum sentence for conviction is one year in state prison — up to maximum of six years), plus fines of $2,000 to $5,000.

Probation in lieu of prison is an option in certain cases, and prosecutors have discretion to plead a felony DUI down to a misdemeanor DUI. For either of these alternatives, you need a lawyer who knows what he's doing. Luke Ciciliano offers experienced DUI defense, examining every aspect of the case for ways to beat the charges:

  • The probable cause for the traffic stop
  • Field sobriety tests and other police observations
  • Evidence from the alcohol breath test or blood test
  • Violations of your constitutional rights

Other DUI-Related Felonies

Causing a death while driving drunk is punishable by a prison term of 2 to 20 years. A DUI accident resulting in serious bodily harm can also be charged as a felony. These cases require knowledge of drunk driving defense as well as other elements of criminal law.

If you are facing a felony DUI, you cannot take it lightly. But you do not have to "take your punishment" either. There are many viable defenses to challenge the prosecution's case or reduce the consequences of conviction. Contact our Las Vegas office today to protect your rights. We are conveniently located behind the federal courthouse at Sixth Street and Clark.
