Felony Domestic Violence
A third conviction for domestic assault is a Class C felony. The penalty is a minimum of one year in state prison (up to five years), plus major fines, community service and counseling requirements. Nevada law forbids dismissal of charges or pleas to a lesser offense unless the district attorney's office admits it cannot prove its case.
Almost anything can be charged as domestic assault — a shove or a slap, a threatening gesture, verbal threats of bodily harm, brandishing a weapon — even if there is no lasting injury. No matter how minor the contact, it will be charged as a felony if this is your third offense. The prosecutor will go forward even if the alleged victim declines to press charges or changes his or her mind.
