Habeas Corpus — Fixing an Injustice
Habeas corpus is a writ allowing a citizen to challenge a conviction and imprisonment on the basis of errors and violations at the trial level, including sentencing. A habeas corpus petition can be filed within one year of an unsuccessful criminal appeal.
While an appeal is limited to issues considered at trial, habeas corpus is wide-ranging: new evidence or new witnesses, evidence excluded at trial, overruled motions, a judge's error in interpreting the law, a prosecutor's tactics. Appeals are heard by the Nevada Supreme Court. Habeas corpus petitions are submitted in District Court.
